Certain rules for lodging a constitutional complaint have changed

As of 1 August 2023, constitutional complaints pursuant to section 26 (1) and Article 27 of the ACC may only be lodged through the court of first instance hearing the case. From this date, it will no longer be possible to lodge a constitutional complaint directly with the Constitutional Court, and the Constitutional Court will not send the constitutional complaint lodged with the Constitutional Court to the court of first instance, nor will it initiate proceedings in the case.
Constitutional complaints may also be submitted electronically to the court of first instance in accordance with the general rules on electronic communication.
In the preparatory procedure before the Secretary General, missing documents requested may still be submitted electronically within the 30-day time limit set out in section 55 (3) of the ACC to the e-mail address hianypotlas[at]mkab.hu. The submission of missing documents must clearly indicate the name of the petitioner or legal representative and the case number of the case to which the submission relates.
Only constitutional complaints pursuant to section 26 (2) of the ACC may be submitted directly to the Constitutional Court in person, by post or by electronic mail to the email address tajekoztatas@mkab.hu.

You can write to the Constitutional Court via the Constitutional Court’s website’s office gateway to request information from the Constitutional Court’s Office, for example on procedural rules and the status of your case. You can also use the office gateway to request information of public interest and to report an incident that may affect organisational integrity. However, it is not possible to submit a motion, a constitutional complaint or to supplement a motion already submitted through the office gateway.
